Jackson County Prosecutor 1 Of 13 Named In Lawsuit Filed By Governor Whitmer

Jackson, MI – As reported, Jackson County Prosecutor Jerry Jarzynka has been named along with 12 other prosecutors in Governor Whitmer’s lawsuit where it appears to be an attempt to get Michigan’s Supreme Court to strike down a 1931 abortion related statute. Jarzynka received a text message from a member of Whitmer’s general council, which led to a phone call where Jarzynka was told he was one of 13 prosecutors being sued by the Governor.

Jarzynka is being represented by the Great Lakes Justice Center.  There is some confusion due to Governor Whitmer not having unilateral authority to attack a state law for being unconstitutional.  Jarzynka looked at the 27 page lawsuit, and said it is based on one line, Article 5, Section 8 which states the Governor can have limited authority to initiate court proceedings for enforcing compliance, or restrain but no more. The Governor does not have Legislative powers.

It appears the goal is to get the case before the Michigan Supreme Court, but it may not end there. Jarzynka believes this case after many appeals has the potential to reach the Unites States Supreme Court, though Jarzynka believes the Michigan Supreme Court could hold up the lawsuit being a slight majority democrat.
